These Terms of Service ("Terms") apply to all reservation requests, bookings, and events contracted between the client ("Client," "you," or "your") and SwissMixx Audio ("SwissMixx Audio," "we," or "us") for professional sound and audio services, DJ services, and any other related services. By submitting a reservation request and/or paying a deposit, you agree to be bound by these Terms.

Booking and Reservation

The reservation and booking forms on SwissMixxAudio.com are provided for convenience only. Submitting a form does not guarantee availability or service. Your reservation is only confirmed once all event details are finalized and your retainer has been successfully received.

SwissMixx Audio cannot be held liable for website, reservation form, or payment processing errors. All reasonable efforts will be made to confirm reservation details and process payments promptly.

Estimates and Retainer

Every estimate carries a "valid until" date. Pricing on a wedding estimate holds for seven days from the date it is sent; other estimates state their own validity. Accepting an estimate is not a booking on its own: the signed agreement is the acceptance, and the retainer is paid against that signature.

A nonrefundable retainer equal to 25% of the total contract value, with a $500 minimum, is required for all reservations and must be paid in advance to hold your date. The date is not reserved until both the signed agreement and the retainer are received.

On full-service bookings, where SwissMixx Audio sets up and operates the equipment, the retainer is the only deposit. No security deposit is taken. A refundable security deposit applies only to bare equipment rentals, as described under Equipment Rentals below.

Balance and Payment

The remaining balance is due two weeks (14 days) prior to the event start date, unless otherwise agreed to in writing. Invoices are paid online through the secure link on the invoice (credit or debit card, or US bank transfer), or by cash, check, or money order made payable to SwissMixx Audio.

A $55.00 administration fee will be assessed for each returned or bounced check.

If full payment is not received prior to the event, equipment will not be set up and no refund will be issued.

If net 30 payment terms are agreed upon in writing, any balance unpaid after the due date accrues a late charge of 1.5% per month (18% per year), or the maximum rate allowed by law if lower, plus reasonable costs of collection.

Cancellation and Refunds

Once a reservation is confirmed via signed agreement, email confirmation, or payment of the nonrefundable retainer, the reservation may only be cancelled or modified in writing by either party.

If you cancel less than 30 days prior to the event, you are responsible for the full contracted fee.

At its sole discretion, SwissMixx Audio may accommodate rescheduling for events cancelled due to inclement weather, serious injury, or death. Rescheduled events are subject to availability.

In the unlikely event of a cancellation initiated by SwissMixx Audio, our liability shall be limited to the value of any unused prepaid service time. A credit or refund will be issued at the sole discretion of SwissMixx Audio within 30 days of the cancellation.

Equipment Rentals

These terms apply to bare equipment rentals, where the Client picks up, sets up, and operates the equipment. The equipment rental agreement signed at booking governs where it differs from this page.

Rental periods. Overnight is a 24-hour period. Weekend is Friday pickup to Monday morning return. Rates for both are published on the rental catalog.
Pickup and delivery. Pickup is free from the SwissMixx Audio shop in Nampa, Idaho, with valid photo identification. Delivery is $250 each way within the Treasure Valley, charged whenever delivery is chosen. Rentals under $400 are pickup only. Utah is served with full-service production only, not bare rentals.
Payment. The rental fee is due before pickup or delivery.
Security deposit. Bare rentals may carry a refundable security deposit in addition to the rental fee; when one applies, the amount is stated on the estimate and the rental agreement. The deposit is taken as an authorization hold on a credit or debit card through the secure link on the invoice; no money is charged unless equipment is lost, stolen, or returned damaged beyond normal wear, in which case only the documented repair or replacement amount is captured and the rest is released. Holds are released automatically after the equipment is returned and inspected, normally within 2 business days and no later than 7 days. It is held and returned within 7 days after the equipment is returned complete and undamaged. Loss or damage charges are deducted from it first, and the Client is responsible for any amount above the deposit.
Damage waiver. Every rental includes a damage waiver of 10% of the rental fee ($25 minimum), shown as its own line on the invoice. It covers accidental damage during normal use. It does not cover loss, theft, water or weather damage, misuse, unverified power, transit in the Client's vehicle, or missing cables, stands, and accessories, which are billed at repair or replacement cost.
Certificate of insurance. The Client may decline the damage waiver, and SwissMixx Audio may waive the security deposit, when the Client provides, before pickup, a certificate of insurance naming SwissMixx Audio as loss payee for the equipment's replacement value. Without one, the waiver is required.
Sales tax. Bare equipment rentals are subject to Idaho sales tax (6%). Delivery charges are stated separately and are not taxed. Services that SwissMixx Audio operates are not taxed.
Late return. Equipment not returned by the agreed return time incurs the late fee stated on the agreement, and after 24 hours may be treated as lost and billed at replacement cost.
Rental cancellation. More than 14 days before the rental start: full refund less a $50 booking fee. 7 to 14 days before: 50% of the rental fee is due. Fewer than 7 days before: the full rental fee is due.

Overtime

When feasible, you may request extended service time during the event. Overtime is available in one-hour increments at the following rates:

$300 per hour before midnight
$500 per hour after midnight

Payment for overtime is due at the time the request is made, payable by credit or debit card, check, cash, or money order.

Venue and Facility Requirements

Unless otherwise agreed to in writing, the Client confirms that:

The performance facility will provide a working space of approximately 12 feet by 8 feet, located within 25 feet of at least two 120-volt, 20-amp outlets on separate circuits (3-prong grounded). For larger productions, eight separate 120V/20-amp circuits are required unless prior written arrangements have been made.
The facility will be accessible at least three hours before the scheduled start time for standard DJ events, and eight hours before for larger productions.
The facility meets all applicable state and federal safety regulations.
Reasonable precautions will be taken to protect SwissMixx Audio equipment and personnel.
For outdoor performances, the event organizer will provide shelter that completely covers and protects all SwissMixx Audio equipment from adverse weather conditions.

The Client accepts full responsibility for any damages, injuries, or delays resulting from failure to comply with these requirements.

In the event of any situation deemed by SwissMixx Audio to present a real or implied threat of injury or harm to SwissMixx Audio personnel, contractors, or equipment, SwissMixx Audio reserves the right to cease or cancel the performance without refund.

Force Majeure

SwissMixx Audio shall not be held liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to: acts of God, acts of war, fire, insurrection, strikes, labor disputes, riots, earthquakes, floods, explosions, or other natural disasters.

Limitation of Liability

The Client acknowledges and agrees that SwissMixx Audio will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of goods, or loss of services, regardless of whether SwissMixx Audio was advised of or could have anticipated such loss or damage.

Intellectual Property

All content on SwissMixxAudio.com, including text, photographs, graphics, and branding, is the property of SwissMixx Audio and may not be copied, reproduced, or used without prior written permission.

Governing Law and Disputes

These Terms are governed by the laws of the State of Idaho. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Canyon County, Idaho, unless the signed agreement for your event states otherwise.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
